FIRST PREFERENCE (EB-1)
EXTRAORDINARY ABILITY – This depends on showing that the applicant received a major international award in their field. It could also combine a combination of evidence including: a lesser award, publications, performing a critical or leading role for an organization, participation on a panel or group judging the work of others, commercial success in the performing arts, or a very high salary.
MULTI-NATIONAL MANAGER – A first preference (EB-1) petition if for someone who has worked for a company as an executive or manager abroad for at least one year out of the last three years before coming to the U.S. If the person will work for an affiliate of that same company in the U.S. as an executive or manager, he or she can bypass labor certification and apply for a green card.
OUTSTANDING PROFESSOR AND RESEARCHER – A first preference (EB-1) petition allows the petitioner to bypass labor certification. To qualify, the applicant must show that he or she has international recognition in a specific academic field, has achieved at least three years of teaching or research in the field, and has either the offer of a tenured, or tenured track position, or for a term of indefinite or unlimited duration, or the offer of a research position at a university or with a private employer.
